Terms of Service
Who this is
This site (nicomikha.com) is operated by Nicomikha, an independent artist and mangaka based in Brazil. By browsing this site, purchasing a product, or commissioning work, you agree to these terms.
Digital products
Brushes, PDFs, guides, and other downloadable files sold on this site are for personal or professional use as described on each product page. Unless a product page says otherwise:
- You may use the files in your own personal, school, or commercial artwork.
- You may not resell, redistribute, or share the files themselves — including uploading them to file-sharing sites or bundling them into your own product.
- Files may include a watermark or embedded buyer information for tracking purposes.
Payments and refunds
Payments are processed by Stripe. Nicomikha never sees or stores your card details. Digital products (brushes, PDFs, guides, and other downloadable files) are delivered instantly upon payment. By completing a purchase, you acknowledge that the file becomes available to you immediately and expressly agree to waive your right of withdrawal (CDC, Art. 49) from that point on, since a delivered digital file can be copied and can no longer be “returned.” For this reason, digital sales are final once the download link is issued — no refunds. If there’s a genuine problem with your order (a broken file, or the wrong product delivered), contact nicomikha7@gmail.com and it will be fixed.
Physical products (currently: printed manga) work differently, since a printed book can’t be copied the way a file can. If your order arrives damaged, defective, or wrong, contact nicomikha7@gmail.com and it will be fixed with a reprint or refund. As required by Brazilian consumer law for purchases made online (CDC, Art. 49), you may also cancel a physical-product order for any reason within 7 days of receiving it, for a full refund — just reach out within that window.
Prices in other currencies
All prices on this site are set in US Dollars (USD). When browsing in another language, prices may also be shown in another currency (such as Brazilian Reais, R$) for convenience — this is an automatic conversion based on the exchange rate at the time, and is only an approximation. The exact amount charged at checkout may vary slightly depending on your payment method and the rate applied that day.
Commissions and custom work
Art commissions, Art Feedback, and roadmap products follow the scope, timeline, and revision terms described on the relevant page or in direct communication. Slots are limited and offered on a first-come basis.
Content and intellectual property
All artwork, characters, and writing on this site are the property of Nicomikha unless otherwise credited. Do not reproduce, trace, or use this artwork commercially without permission.
Limitation of liability
This site and its products are provided as-is. Nicomikha is not liable for indirect damages arising from the use of downloaded files or guides.
Governing law
These terms are governed by the laws of Brazil. If you are a consumer located in a country that grants you additional mandatory consumer protections, those protections may still apply to you regardless of this clause.
Privacy Policy
What data is collected
Depending on how you interact with this site, the following personal data may be collected:
- Contact form / newsletter: name and email address, and any message you write.
- Purchases: handled entirely by Stripe (our payment processor) — name, email, and payment details are collected and processed by them, not stored on this site.
- Basic browsing data: standard hosting logs from Hostinger (our web host), such as IP address and browser type, used only for security and performance.
Why it’s collected
Data is used only to: deliver a purchased product, respond to a message or commission request, and — if you opt in — send occasional updates about new roadmaps or products. We do not sell or share your data with advertisers.
Third parties involved
- Stripe — payment processing
- Hostinger — website hosting
- SoundCloud — embedded music players on the Music page (SoundCloud may set its own cookies when you play a track)
- MailPoet — manages the email list if you sign up for updates; your email is stored with them until you unsubscribe
- Google Site Kit (Google Analytics) — basic, aggregated site traffic statistics (pages visited, general location, device type) — not used to identify you personally
Cookie policy
This site uses a small number of cookies — no third-party advertising cookies, and nothing sold to advertisers:
- Essential: WooCommerce’s cart/session cookies, needed for checkout to work — these can’t be turned off without breaking the ability to buy anything.
- Analytics: Google Site Kit (Google Analytics) sets cookies to measure aggregated site traffic (pages visited, general location, device type) — not used to identify you personally.
- Third-party embeds: SoundCloud may set its own cookies if you play a track on the Music page.
Essential cookies are always on, since checkout can’t function without them. For analytics, a cookie banner appears on your first visit letting you accept or decline before any analytics cookie is set — declining still lets you browse and buy normally. You can also block or delete cookies at any time through your browser’s settings.
Your rights (LGPD)
Under Brazil’s General Data Protection Law (LGPD), you have the right to request access to, correction of, or deletion of your personal data, and to withdraw newsletter consent at any time. To exercise any of these rights, contact nicomikha7@gmail.com.
GDPR (European visitors)
If you are located in the European Economic Area or the UK, the General Data Protection Regulation (GDPR) also applies to how your data is handled here, alongside Brazil’s LGPD. You have the same core rights described above — access, correction, deletion, and objection to processing — through the same contact channel. Nicomikha does not have a dedicated EU representative; as a small business with only occasional sales to the EU, this currently falls under GDPR’s exemption for occasional, low-risk processing (Art. 27(2)). This will be revisited if that changes.
Data retention
Purchase records are kept as long as needed for accounting and support purposes. Newsletter emails are kept until you unsubscribe.
